41 Sharia Principles

41 Sharia Principles according to Article 720 of the CTL.

According to Article 720 of the CTL, the rules mentioned in this Article shall be applied to the extent that it does not conflict with statutory provisions, considering their nature and the conditions and exceptions related to each of them, which are:

Rule 1: All matters are considered by its purpose.

Rule 2: Intentions and meanings, not words and sentences, shall be only taken into consideration in contracts.

Rule 3: Custom is basis for judgment.

Rule 4: Assignment by custom is similar to assignment by text.

Rule 5: Known customarily is just as provisional condition.

Rule 6: Usually refraining is just as real refraining.

Rule 7: Certainty is not diminished by doubt.

Rule 8: The rule is the survival of what was as it was.

Rule 9: Acquittance is the rule.

Rule 10: The rule in contracts and terms is validity and necessity.

Rule 11: The rule in accidental attributes is non-existence.

Rule 12: The rule is to add the incident to its earliest times.

Rule 13: A saying is not attributed to a silent person, but silence in the event of the need for a statement is a statement.

Rule 14: There is no significance in the statement confrontation.

Rule 15: There is no significance in assumption proven to be wrongful.

Rule 16: Damage may be elapsed.

Rule 17: Damage may be elapsed only through a similar damage.

Rule 30: What is unforgivable in the beginning is forgiven in survival.

Rule 31: If the root falls, the branch falls.

Rule 32: There is no excuse for diligence in the text resource.

Rule 33: Any debt is outstanding until payment.

Rule 34: Guarantee is for damage or loss.

Rule 35: Should a duty not be fulfilled except by a matter, that matter becomes a duty.

Rule 36: If the barrier is removed, the forbidden shall be returned.

Rule 37: What has been proven for an excuse goes away with its demise.

Rule 38: The fallen does not return.

Rule 39: If the original is not available, it shall be replaced.

Rule 40: Whoever sought to reverse what was done on his part, his effort is rejected.

Rule 41: Ignorance of judgment is no excuse.
